Sales Conditions

These Sales Conditions set out the terms applicable to transactions made through the Blisterr platform (peeks, lives, auctions, instant buy). They supplement the Terms of Service and the Code of Ethics. Definitions used here are those of article 2 of the Terms.
1. Purpose and scope
These Sales Conditions govern the sale of items between buyers and sellers (private or professional) through the Blisterr platform, whatever the sale format (peek, live, standard or silent auction, instant buy).
Blisterr SAS acts as a technical intermediary and platform operator within the meaning of articles L.111-7 et seq. of the French Consumer Code. Blisterr is neither the seller nor the buyer of the items, unless expressly stated.
2. Parties
- Private seller: an adult user occasionally selling personal items.
- Professional seller: a user acting in the course of their commercial, craft, professional or agricultural activity. They identify themselves as such and provide legal information (company name, SIRET, VAT).
- Buyer: an adult user making a purchase for personal or professional use.
- Blisterr: platform operator, payment processor via Stripe, and provider of shipping tools.
3. Listings and offers
Sellers are responsible for the content of their peeks, lives and product pages: title, description, photos, videos, declared condition, price, shipping fees and special conditions. The information must be accurate, complete, up-to-date and lawful.
Listing an item constitutes a firm offer at the stated conditions. The seller undertakes to honour the sale if a buyer purchases at the listed price or wins an auction.
4. Peeks, lives and auctions
4.1 Peeks
A peek is a short vertical video presenting an item. The item may be offered for instant buy or auction (standard or silent).
4.2 Lives
A live is an interactive live broadcast during which the seller presents and sells items in real time. Purchases may take the form of an auction or instant buy depending on the format chosen by the seller.
4.3 Auctions
Two formats are offered:
- Standard auction: bids are visible to all.
- Silent auction: bids are hidden until close.
The item goes to the highest bidder at the end of the time limit. Any bid placed is a firm, final and irrevocable commitment to pay as soon as it is winning. The bidder cannot withdraw their bid or reverse their participation, save for a clear technical error of the platform.
Any winning bid must be settled within 9 days. Failing this, Blisterr may suspend the account, restrict future payment methods, award the item to the second-highest bidder, relist it or initiate recovery action.
5. Conclusion of the sale
The sale is concluded as soon as Stripe validates the payment. A confirmation email is sent to the buyer and a notification to the seller. The seller then undertakes to ship the item within the stated time frame.
6. Pricing, payment and fees
6.1 Prices
Prices are displayed in euros, inclusive of taxes where the seller is a VAT-registered professional. Private sellers do not charge VAT.
6.2 Payment methods — exclusively via Blisterr
The buyer may pay by:
- bank card (Visa, Mastercard, American Express where available);
- Apple Pay and Google Pay;
- Blisterr wallet balance (where available).
Payments are processed by Stripe Payments Europe, Ltd. (Ireland). Blisterr stores no bank data.
Any other payment method is strictly prohibited. In particular, the following are excluded: direct bank transfer, PayPal, cash, cryptocurrency, external Stripe link, and more generally any payment made outside the channels integrated into the platform. This prohibition applies to both sellers and buyers and covers any transaction initiated through Blisterr (peek, live, auction, instant buy, messaging).
Only payments via Blisterr give rise to escrow, buyer protection and mediation. Any violation may result in immediate account suspension, escrow of pending funds and exclusion from the buyer protection program.
Abusive or fraudulent chargebacks (unjustified Stripe disputes when the item has been received as described) are subject to account suspension and recovery by Blisterr.
6.3 Fees (summary — details in annex of the Terms)
- Buyer: 6.9% of the transaction amount + €0.49 per transaction.
- Seller: 0% commission. The seller receives the full sale price.
- Shipping fees: borne by the buyer, calculated based on the chosen method and destination.
- Wallet withdrawal (seller): 1 free withdrawal every 40 days, then 3% + €1 per additional withdrawal within the same window.
Sale proceeds are credited to the seller’s wallet after the buyer’s validation or, failing any dispute, about 3 weeks after delivery (standard Stripe Connect window).
6.4 Invoicing
Professional sellers are responsible for issuing their invoices in accordance with applicable regulations. Blisterr provides the transaction details required for invoicing and, where applicable, electronic invoices generated through its e-invoicing partner.
7. Purchase, shipping and bundling
7.1 Order bundling
Orders from the same shop can be bundled as long as the first one has not been shipped, allowing buyers to mutualise shipping fees.
7.2 Shipping methods
Blisterr offers the following carriers: Mondial Relay, Colissimo (La Poste) and Chronopost. Additional carriers may be added and listed in the checkout flow.
7.3 Shipping window
The seller has the shipping window displayed on their shop profile. Failing shipment within that window, the buyer may request cancellation and refund.
7.4 Shipping fees
Shipping fees are calculated based on the declared weight and destination. Any manifest discrepancy between the declared weight and the actual weight may give rise to a correction.
7.5 Transfer of risk
Pursuant to article L.216-4 of the French Consumer Code, in sales between a professional seller and a consumer, the risk of loss or damage to the item is transferred to the consumer upon delivery. In peer-to-peer sales, the risk is transferred upon handover to the carrier, subject to any insurance taken out by the buyer.
7.6 Tracking
Order tracking is available from Menu > Orders.
8. Right of withdrawal
8.1 Sale by a professional to a consumer
Pursuant to articles L.221-18 et seq. of the French Consumer Code, the consumer has 14 days from receipt of the item to withdraw, without reason. The standard form is provided in the annex; any letter expressing the wish to withdraw may also be sent to the seller or via Blisterr messaging.
The item must be returned within 14 days of the withdrawal notice, in its original condition. Return shipping costs are borne by the buyer unless the seller states otherwise. The refund is issued within 14 days of the notification, subject to the return of the product.
8.2 Peer-to-peer sales
The right of withdrawal under the Consumer Code does not apply to peer-to-peer sales. The Blisterr buyer protection program (article 9) remains applicable.
8.3 Exceptions to the right of withdrawal
Pursuant to article L.221-28 of the French Consumer Code, the right of withdrawal does not apply notably to:
- goods unsealed or opened after delivery that cannot be returned;
- goods made or personalised at the buyer’s request;
- public auction sales.
8.4 Items opened or unsealed during a live
The buyer expressly acknowledges that items put up for sale during a live and opened, unsealed, unpacked or revealed during the broadcast at the buyer’s request or in their direct presence (in particular: opening of boosters, packs, boxes, displays, mystery boxes) constitute goods clearly personalised within the meaning of article L.221-28 of the French Consumer Code, and are accordingly excluded from the right of withdrawal.
The buyer of a booster or sealed pack purchased during a live and opened during the broadcast accepts to acquire the revealed content as is, without recourse to withdrawal, return or refund based solely on the randomness of the content. The Blisterr buyer protection program remains applicable only in case of a substantial defect unrelated to the draw randomness (for example: repackaged pack, proven counterfeit, item damaged before opening).
More generally, auctions won on Blisterr do not give rise to a right of withdrawal, the bid being a firm and irrevocable commitment within the meaning of article 4.3 above.
9. Warranties and buyer protection
9.1 Statutory warranties
For sales by a professional, the consumer buyer benefits from the statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).
9.2 Blisterr buyer protection
Blisterr operates a buyer protection program applicable to all sales (peer-to-peer or professional) in case of item not received, item materially different from the description, or proven counterfeit. The buyer must open a dispute via the app within 30 days of receiving the item (or the expected delivery date in case of non-receipt). Blisterr investigates and may, depending on the case:
- request evidence from the parties;
- propose mediation;
- order a full or partial refund;
- trigger a return at the seller’s expense.
If no amicable resolution is reached, funds may be held in escrow until a court decision.
10. Disputes between users
Users are encouraged to resolve disagreements amicably via the platform messaging. If the dispute persists, the buyer can open a case (article 9). Blisterr may, as a precaution, freeze the disputed amounts in the wallet until a final decision.
11. Dispute resolution and jurisdiction
In accordance with EU Regulation No. 524/2013, consumers may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
These Sales Conditions are governed by French law. If a dispute is not resolved amicably within 30 days of notification, the courts of Bayonne, France shall have jurisdiction, subject to consumer protection rules.
12. Sanctions
In case of breach of these Sales Conditions, Blisterr may apply the measures listed in article 20 of the Terms of Service (content removal, payment restriction, suspension, termination, escrow of disputed amounts, cooperation with authorities).
