1. Purpose
These Terms of Service (“Terms”) set out the conditions and procedures for accessing the Blisterr website and application, as well as the rules applicable to the use of the services offered (the “Services”).
Blisterr enables users to buy, sell and trade items through peeks (product videos) and lives (interactive live sales), in a secure and community-driven environment.
2. Definitions
“Blisterr” or “the Provider”: the company BLISTERR, a French SAS with share capital of €1,000, registered with the Bayonne trade register (RCS Bayonne) under number 918 924 556, with registered office at 3 rue Denis Etcheverry, 64100 Bayonne, France.
“Site” or “App”: the web and mobile interfaces accessible via https://blisterr.com and the associated mobile application.
“User”: any person accessing the Site or the App, whether buyer, seller or visitor.
“Buyer”: a user who purchases an item from a seller.
“Seller”: a natural or legal person, professional or private, operating a shop on Blisterr.
“Shop”: the personal space where a seller publishes and manages their peeks and lives.
“Peek”: a short video presenting an item, which can be offered for direct sale or via auction (standard or silent).
“Live”: an interactive live broadcast during which a seller presents and sells items in real time.
“Item”: any good or product offered for sale on the platform.
“Wallet”: the integrated digital wallet used to make payments and receive sale proceeds.
“Payment provider”: Stripe, the licensed operator handling payments on Blisterr.
“Host”: Hetzner Online GmbH (Germany), the company providing application hosting and storage of user data within the European Union.
“Code of Ethics”: the document defining best practices on Blisterr.
“Privacy Policy”: the document describing the collection and processing of personal data.
“Applicable Regulations”: all French and European laws, including the Civil Code, the Consumer Code, the GDPR and the French Data Protection Act.
3. Acceptance
Access to and use of Blisterr require full acceptance of these Terms.
Acceptance is given when the account is created by ticking the appropriate box.
These Terms are accessible at any time via a link at the bottom of every page of the Site or in the App.
4. Contractual hierarchy
In case of contradiction between these Terms and any other document or page of the Site, these Terms prevail. The specific policies (Code of Ethics, Privacy Policy, Sales Conditions, etc.) supplement these Terms.
5. Amendments to the Terms
Blisterr reserves the right to amend these Terms at any time.
Amendments take effect upon publication.
Users are invited to consult the Terms regularly.
6. Description of the Services and role of Blisterr
Blisterr provides an intermediation platform between buyers and sellers.
It offers tools for presentation (peeks, lives), messaging, payment and moderation.
Blisterr is not the seller of the items and does not guarantee their conformity, authenticity or condition.
Its role is limited to facilitating transactions, securing payments and providing mediation in case of dispute.
7. Account registration
Registration is free and reserved for adults.
The information required includes: first and last name, email, date of birth and, for sellers, bank details and legal information.
Account access is via a secure login code sent by email or SMS.
The User is solely responsible for the confidentiality of their credentials and for any activity linked to their account.
8. Access and availability
The Services are available 24/7, except for interruptions for maintenance, security or force majeure.
No compensation may be claimed in the event of temporary unavailability.
Users must use an up-to-date and secure technical environment.
9. Fees, payments and Wallet
9.1 Service fees
- Buyer: 6.9% of the transaction amount + €0.49 per transaction. These fees are charged only on completed transactions and refunded if the order is properly cancelled.
- Seller: 0% commission. The seller receives the full sale price displayed.
9.2 Payments
Payments are processed exclusively through Stripe, the licensed provider supplying the secure payment infrastructure.
Blisterr stores no bank data.
The integrated wallet allows users to manage balances, top-ups, sales and withdrawals.
9.3 Escrow and release of funds
Amounts paid are credited to the seller’s wallet:
- after the buyer’s validation, or
- automatically about 3 weeks after the carrier delivery date, in the absence of any registered dispute.
9.4 Withdrawals
- Buyers: free withdrawals.
- Sellers: one free withdrawal every 40 days, then 3% + €1 per additional withdrawal made within the same window.
10. Purchase, shipping and order bundling
Purchases can be made from peeks or from lives.
Orders from the same shop can be bundled as long as the first one has not been shipped.
Shipping fees are calculated on the basis of the declared weight; any manifest discrepancy may give rise to a correction.
Tracking is available from Menu > Orders.
The carriers offered are Mondial Relay, Colissimo (La Poste) and Chronopost. Additional carriers may be added and listed in the checkout flow.
The full terms (shipping methods, delivery times, transfer of risk, right of withdrawal, warranties, buyer protection, disputes) are set out in the Sales Conditions.
11. Auctions
Two formats: standard (visible bids) and silent (hidden bids).
The item goes to the highest bidder at the end of the time limit.
Any bid placed is a firm, final and irrevocable commitment to pay by the bidder as soon as it is winning. The bidder acknowledges that they cannot withdraw their bid, reverse their participation, or contest the allocation save for a clear technical error of the platform.
Any winning bid must be settled within 9 days.
Failing settlement within this period, Blisterr may:
- temporarily or permanently suspend the account;
- restrict future payment methods to wallet only;
- award the item to the second-highest bidder or relist it;
- initiate appropriate recovery action.
11 bis. Payments exclusively via Blisterr
Any transaction initiated through Blisterr (peek, live, auction, instant buy, messaging) must be completed exclusively via the payment methods integrated into the platform (bank card, Apple Pay, Google Pay, Blisterr wallet) processed by Stripe.
The following are strictly prohibited:
- redirecting a buyer or seller to an external payment method (direct bank transfer, PayPal, cash, cryptocurrency, external Stripe link, etc.);
- any proposal, attempt or suggestion to complete a sale off-platform;
- the exchange of bank credentials, IBAN, phone numbers or addresses for the purpose of bypassing Blisterr’s payment system;
- sharing a cart or a payment link with a third party in order to bypass fees or buyer protection.
This rule protects both sellers and buyers: only payments via Blisterr give rise to escrow, buyer protection and mediation. Any violation may result in immediate account suspension and seizure of funds in transit.
Abusive or fraudulent chargebacks (unjustified Stripe disputes when the item has been received as described) are also subject to account suspension and recovery by Blisterr.
12. Right of withdrawal (consumer buyers)
Applicable only when the seller is a professional.
Pursuant to the French Consumer Code, the consumer has 14 days from receipt of the item to withdraw, without reason.
Refund within 14 days of notification, subject to the return of the product.
A standard withdrawal form is attached to the Sales Conditions.
13. Ratings and reviews
Buyers rate sellers on:
- item quality;
- packaging;
- shipping;
- communication.
Sellers rate buyers on:
- payment reliability;
- communication;
- adherence to deadlines;
- overall experience.
Ratings are publicly visible on profiles.
14. Messaging and reports
The internal messaging system is intended for exchanges related to sales. Any inappropriate content or behaviour can be reported via the “Report” function or by email to support@blisterr.com.
Reports are handled by the Blisterr team and may result in account suspension or removal.
15. Rules of conduct
The User undertakes to:
- comply with the Code of Ethics;
- not divert the service for external commercial purposes;
- not publish illegal, defamatory, hateful or misleading content;
- not impersonate another person;
- not circumvent Blisterr’s payment mechanisms (article 11 bis);
- not initiate abusive or fraudulent chargebacks with Stripe;
- not create multiple accounts to bypass a suspension, a ban or buyer protection;
- not manipulate reviews, ratings or content visibility by artificial means.
Any breach may result in immediate suspension or termination of the account, escrow of amounts due, and where appropriate legal proceedings.
16. Intellectual property
All components of Blisterr (interface, design, software, trademarks, databases) are protected by intellectual property law and belong exclusively to Blisterr.
The User grants Blisterr a non-exclusive, royalty-free licence to host and display their content for the technical purposes of operating the platform.
No reproduction, copying or unauthorised exploitation is permitted.
17. Moderation and disputes
Blisterr operates both human and automated moderation.
In the event of a dispute between a seller and a buyer, Blisterr may act as a technical mediator.
If no amicable resolution is reached, funds may be held in escrow until a court decision.
Blisterr is not liable for the failure of mediation.
18. Liability
Blisterr acts as a technical intermediary.
Its liability cannot be engaged for the faults of the seller, the buyer, the carriers or the payment provider, nor for any case of force majeure.
In any event, Blisterr’s liability is limited to direct, certain and foreseeable damage.
19. Personal data
Use of the Site/App involves the processing of personal data.
These processing operations are detailed in the Privacy Policy, accessible from the App or https://blisterr.com.
Payments being processed by Stripe, Blisterr stores no bank data.
Hosting is provided by Hetzner Online GmbH (Germany), ensuring that data is stored within the European Union.
20. Suspension and termination
In case of breach of the Terms or the Code of Ethics, Blisterr may suspend access to all or part of the Services, or terminate the account without notice, in particular in case of:
- fraud or attempted fraud;
- non-payment of a winning bid;
- publication of unlawful or misleading content;
- threat to the security of the platform.
21. Assignment
The User may not assign these Terms.
Blisterr may transfer them to any third party of its choice without specific formality, the transfer being notified to the User.
22. Force majeure
Neither Party shall be held liable in case of an unforeseeable, irresistible and external event (force majeure) making the performance of the contract impossible.
23. Evidence
Electronic records, histories and connection logs produced by Blisterr have probative value between the parties.
24. Mediation and consumer disputes
Any consumer may use the European Online Dispute Resolution platform free of charge: ec.europa.eu/consumers/odr.
25. Governing law and jurisdiction
These Terms are governed by French law.
If a dispute is not resolved amicably within 30 days of notification, the courts of Bayonne, France shall have jurisdiction, subject to consumer protection rules.
Annex 1 — Fees and payments
- Buyers: 6.9% + €0.49 per transaction.
- Sellers: 0% commission.
- Seller withdrawals: 1 free every 40 days; then 3% + €1 per additional withdrawal.
- Release of funds: after buyer validation, or about 3 weeks after delivery.
- Payments: via Stripe (no bank data stored).
- Winning bid settlement: within 9 days.
